AMERIPEN endorses the Packaging and Claims Knowledge (PACK) Act introduced by Congressman Randy Weber of Texas's 14th district. The legislation aims to standardize state laws on recyclable, compostable, and reusable claims for consumer packaging.

AMERIPEN backs the bill for establishing a federal framework under the Federal Trade Commission (FTC) governing such claims. This national approach replaces varying state regulations, enabling businesses to deliver clear information nationwide. It reduces confusion among consumers, supports informed decisions, and encourages proper end-of-life management of packaging to reduce landfill waste and foster a circular economy.

The bill features mandatory third-party certification for consumer packaging claims. Accredited bodies verify compliance with industry standards and FTC Green Guides, preventing misleading statements. Businesses can select from qualified independent certifiers.

Certification targets consumer packaging variations in type, shape, size, and color. Non-consumer packaging remains exempt from this requirement.

The act preempts states from imposing non-identical rules, creating a consistent national standard. This eliminates interstate commerce barriers, minimizes consumer confusion, and ensures correct handling of packaging.

AMERIPEN plans to collaborate with Congressman Weber and Congress to advance the legislation.
